looks good at the bay bridge toll plaza. let's go back to the dave and pam. topping our news this morning we are following breaking news. a fatal police shooting in fremont. ktvu janine de la vega joins us now from the scene. this is add central -- at central avenue. this started as a domestic dispute? >> reporter: it appears that way. police are still on the scene processing it. they are actively investigating. they have both sides of the street closed here at central avenue and glen more drive. for about a city block it's closed. that is because they are investigating this shooting that happened in the apartment complex where you see all those police cars parked. this happened at 11:00 last night. they received a call from a woman two told dispatchers her husband was attacking her roommate. he was chasing one of them with a knife. when police aryed they found the woman and roommate fleeing the apartment and found the man chasing them. police tell us he was naked and

holding a knife and that is when officers told the man to drop the knife. he didn't and so that is why officers felt that they had to shoot him. we're not -- we're unsure how many times he was shot. we are told he died of his injuries. at this point we foe that two officers who were involved in that shooting are now paid administrative leave. we are being told one has been with the department for three years the other one has been with the department 20 plus years. these other officers that are on the scene again are still gathering evidence, talking to witnesses, really still trying to piece together what happened here. and why this man was supposedly chasing at least one of the women with a knife. right now we're being told that the police spokeswoman is on her way so that we can get a little bit more details of what happened here. reporting live from fremont janine de la vega ktvu channel 2 news. time is 5:02.

new this morning a teenage driver now being questioned by police after a bizarre overnight car crash in oakland's china town. ktvu tara moriarty is live now with the details and also why that out of control car slammed into a fabric store. good morning. >> reporter: good morning. the damage is pretty extensive. you can see where this pickup truck slammed into the corner of this fabric store. and it caused quite a bit of damage. but it actually started across the street where that gate is missing right there. witnesses say around midnight a man was picking his father up from work in his pickup truck got stuck in the gate. instead of hitting the brake he hit the gas pedal. the truck also hit a water line. so crews had to turn the water off. they were also forced to cut power because there were electric boxes above the scene of the crash. firefighters rolled the truck out of the store front and later towed.

no word yet on what caused the accident. it doesn't appear drug or alcohol played a role. live in oakland i'm tara moriarty. our time now 5:03. overnight fire damaged a pleasant hill business and police say it looks suspicious. now it happened at a strip mall on contra costa boulevard near concord avenue. here are live pictures. this is the scene. this is the nail salon that caught fire last night at 11:00. fire crews say the front window was smashed out. they also say they discovered what appears to be a molotov cocktail inside. fire crews are continuing to investigate treating it as a criminal investigation. meantime the red cross helping a san leandro family trying to find a place to live after fire badly damaged their homes. firefighters rushed to the scene at san leandro boulevard at 8:30 last night. two people in the house were trying to put out the flames. fire crews were able to put it out in 20 minutes.

investigators say it's still not clear how that fire started. both president obama and mitt romney are making their way through the battleground states on their last day of campaigning before election day tomorrow. coming up at 5:15 where the candidates stand in the latest polls. election officials say they are hopeful super storm sandy won't keep the voters from the polls despite wide spread power outages. in new jersey governor chris christie will be able to cast paper ballots. they will also have the option of faxing or e-mailing their ballots. voters in some new york counties could get an extra day to cast ballots if turnout falls below 24%. >> you will all vote old school. you will vote paper ballot. which means we'll take it a little longer to count but everyone will have their opportunity to count. >> we will do whatever we can. we have got to make sure

everybody can vote. >> voters in new york could have an especially tough time casting a ballot. polling locations have been relocated or combined due to the storm. time now almost 5:06. new this morning a small earthquake in a part of new jersey still recovering from the super storm. it was a magnitude 2.0 quake centered in ringwood new jersey. they are still dealing with down trees and power outages. now wile the quake didn't cause any damage, some people heard a loud woman woman -- loud boom. today back to school and work for millions of people at least they will try in new york and new jersey today for the first time since that big storm. it could be very, very, very tough commute into the city. but many public transit routes still without of service and gas hard to get. 80% of new york city subway system has now reopened. new york mayor michael

bloomberg says he's planning to join thousands of commuters by taking the subway to work. muni is celebrating 100 years of service in the bay area and for the rest of the week you can expect to see vintage streetcars, cable cars, buses, trolley coaches, you may even get the chance to ride one. several vintage streetcars will operate this week on the f-line between the castro district and fisherman's wharf. keep an eye out for memorabilia on display from muni's early years as well. the streetcar festival lasts until sunday. >> that sounds interesting. time now 5:07. sal is back. can you help the folks on the east shore, sal? >> no. okay all right. since you asked so nice, dave yes, i can. i can help everyone. we're off to a nice start on this monday as you drive around the bay area on 80 westbound and getting out. i can't help you if you don't want monday to be here.

time now 5:13. seven people including four children are safe this morning after they were rescued from a capsized boat in marin county. now look at that rescuers used that saw to free two young children. they were trapped for 90 minutes in that upside down boat. before that, a helicopter plucked two other children and three adults taking them to safety. their boat overturned near the mouth of tomales bay yesterday afternoon. authorities say no one was

wearing a life jacket and every one of them is lucky to be alive. >> thank god the kids got home safely. they were kids too. a young boy and girl. >> those two children were rushed to the hospital treated for severe hyperthermia. one adult suffered minor injuries. it's still not clearway the boat flipped over. rescuers say it's possible six to eight foot swells were a reason. closing arguments this morning in the trial of a san francisco man accused of trial three violent sexual assaults. frederick dozer is charged with three sexual accounts. right along the 24th corridor and san francisco mission district. if he is convicted he could get life in prison. a court hearing also scheduled for a san rafael teenager trying to kill two people and stealing the lamborghini of celebrity chef. he was ordered to stand trial

boy was killed by a pack of wild dogs staff he fell into the cage. she was trying to give him a better view. he was attacked by 11 of the wild dogs. authorities say zoo staff responded quickly but it was too late. we still don't know if this child died from the fall or from the attack by the dogs. back here at home it looks like muni will be making a big payment as a result of vandalism caused by some of the celebrating giants fans. according to the san francisco chronicle muni will have to pay $700,000 to replace a bus set on fire by giants fans celebrating after the world series. what turns out san francisco's insurance policy doesn't cover the torching of buses. that is going to hurt the transit agency. they just spent about $300,000 refurbishing buses last year. 5:17 is the time right now.

sal, has a look at traffic this morning. how does it look? >> it looks pretty good pam and dave. so far any way if you are driving around the bay area. let's take a look at what we have now. northbound and southbound 280 that traffic is moving along very nicely and no problems on 101 or 85 getting into the valley. also this morning we are look at the commute that looks good on interstate 880. driving northbound on the right. you can see traffic looks good all the way past high street and into downtown oakland. highway 4 from antioch to bay point it's a nice looking drive. still nothing on the road sensors. probably won't stay that way. and across the bay if you are driving from novato to san rafael it's a nice looking drive. here is steve. thank you very much, sal. a little bit of patchy fog but that is it. santa rosa and napa say it won't last long. nights now we set the clocks back much, much longer. temperatures today with the shorter days are heading up. in fact today looks to be the warmest day of the week and

high-rise and out to highway 92. let's go to the desk. breaking news just hours ago. police in fremont shot and killed a man after responding to a domestic dispute. this with a story we've been following since 4:30. ktvu janine de la vega is at the scene. you're at central avenue and police just gave you an update. what are they saying? >> they gave me a little bit more details of what happened. it was a violent domestic dispute. let me give you an idea of where this is. central avenue in glenmore drive you can see the road is blocked off here. both sides of the street and where all the police cars are is where the violent confrontation occurred between a husband and estranged wife which ultimately ended in that man's life. police received a 911 call from a woman who said his roommate was being attacked by her husband. the caller was hiding behind the door. when police arrived they saw a woman running from the apartment and a naked man

holding a knife chasing her. that is when officers confronted the man. >> officers demanded that the suspect stop, drop his weapon. when he refused to do so, officers fired their weapon. the suspect was transported to a local trauma center where he was later pronounced dead. >> reporter: we are told by police that man was 37 years old and he was from san jose. his wife was taken to a nearby hospital to be checked out but we're told she is okay. police are interviewing her. they do believe that they were an estranged couple because they did not live together. the roommate the person that called this in she is okay. she is being interviewed by police and back at the police station. top officers involved in this shooting are now on paid administrative leave. officers are still processing this scene. they are interviewing witnesses and gathering evidence. as far as the residents that live in the area. a lot of them had to park far

away and then walk in because right now at this point, no one is being allowed in. if they were here when the incident happened and they could stay here, but some people who are just driving up and wanting to get home, they are not allowed to drive in because again this is still an active police investigation. we're also being told as far as in the city of fremont this is the first officer involved shooting of the year. reporting live from fremont janine de la vega ktvu channel 2 news. in overnight news a nail salon in pleasant hill badly damaged after it went up in flames. alex savidge joins us now from the strip mall where it all happened with more on what fire crews discovered that is making them call this fire suspicious. >> the arson investigator here on scene it appears someone intentionally set fire to this nail salon. the reason red flags were raised this morning is because of the molotov cocktail or what appeared to be a molotov cocktail found outside of this business when the first crews

arrived here. criminal investigation has been launched. work is being done inside this business. the fire was also suspicious because the front window of the place was broken. when the first crews got here. started around 11:30 last night at the magic touch salon. the alarm sounded inside the place. it's in a strip mall on contra costa boulevard. the fire inside was fairly small. crews knocked it out quickly but firefighters noticed what appeared to be an insipid area device. a beer bottle with some kind of liquid inside. a contra costa county fire investigator has been here here throughout the morning processing this scene. he is trying to figure out what was used to set this fire. he has ruled out any accidental causes. >> when we arrived as investigators at a fire scene, our first attempt is try to determine where the fire may have started. we try to get that to a small enough area as we can and once you determine the area where the fire started you may pretty much be on your hands and knees

sifting through fire debris. >> reporter: the fire investigator will have some of the debris samples collected to test for accelerants and that cocktail will be tested at a lab as well and tested for fingerprints as investigators try to key in on the arsonist. investigators thus far have not been able to reach the owner of this business. live this morning in pleasant hill alex savidge ktvu channel 2 news. four people are dead seven others are in the hospital following a head on crash south of sacramento. it happened at about 4:00 yesterday afternoon on northbound interstate 5 near the elk grove boulevard exit. the chp says an suv heading south on the highway carrying nine people lost control, crossed the center divide and hit a car that was heading north. the highway was shut down for several hours. the chp is now looking into what caused the crash. time now 5:35. both president obama and mitt romney making one final

campaign push today before election day tomorrow. coming up at 5:45 we'll bring you a live report from boston. that is where mitt romney will be tomorrow to watch the election results come in. the california supreme court has ordered an arizona group to reveal who is behind an $11 million contribution to two campaigns here in california. the arizona pack is funding campaigns against prop 30. that is governor jerry brown's tax hike proposal and for proposition 32 which would limit the ability for unions. a california teacher -- california teachers are working phone banks all over the state encouraging people to vote for prop 30 tomorrow. and critics of prop 30 are working just as hard to encourage a no vote. >> this is all about creating positive learning environments for kids. and if we have to take another $6 billion cut come january, it's going to be horrendous. >> the at amount of money that

will flow through to classrooms is way less than what is being reflected in a lot of the advertising campaign. >> prop 30 would raise income taxes on those who earn more than $250,000. it also increases sales tax a quarter cent. it needs more than 50% of the vote to pass. the east coast is preparing for another big storm even as the region continues to recover from sandy. the national weather service says a nor'easter could hit midweek causing more beach erosion, flooding, and rain. thousands of homes still without power in new york city where temperatures are expected to drop into the 20s overnight. officials say the city may have to find temporary housing for as many as 40,000 people who's homes do not have heat. eight california emergency management agencies managers are heading to the east coast to help with storm relief. the agency says it is deploying experts from throughout the state including in the bay

area. they will be offering assistance in new york about 30 miles north of new york city. time now 5:37. sal is back. you're watching the east bay still. >> that is right. the traffic is getting a little bit busier dave and pam. on 80 especially. westbound 80 you see more traffic here and also in vallejo and pinole. some more people are joining us. it's kind of a gradual addition but you can definitely see it. at the bay bridge still not a big crowd although there is a little bit of waiting in some of the left lanes. people might be showing up a little bit earlier. the clocks are a little off at least for some. the traffic is just a little earlier than we normally see it. marin county southbound 101 traffic does look good as you dave through. if you're driving on highway 4 from antioch to pittsburgh to bay point it's a nice looking drive and we talked about 80 you can see the road sensors confirming. it's getting busier but not stop and go just yet. let's go to steve. >> thank you.
